Sanctioning Justice: The Dangerous Precedent of Trump’s ICC Order

Orwell Was Right: Trump, Netanyahu, and the Death of International Law

The Death of International Justice: Trump’s War on Accountability

“Reject the evidence of your eyes and ears.” Orwell’s warning echoes today as President Trump, alongside Benjamin Netanyahu, signed an executive order sanctioning the International Criminal Court. In doing so, he didn’t just attack an institution – he hammered another nail into the coffin of international accountability.

The irony is staggering. Here stands a president, who himself faced multiple indictments, now declaring that the world’s foremost institution for prosecuting war crimes is “illegitimate.” The same court that emerged from the ashes of Yugoslavia and Rwanda, created precisely to ensure that “never again” meant something. Yet Trump, with characteristic disdain for international norms, has deemed it worthy of sanctions.

Sanctioning the ICC: Trump’s Final Assault on International Law

“The party told you to reject the evidence of your eyes and ears. It was their final, most essential command”.

George Orwell’s final order of the Party -1984

Let’s be crystal clear about what we’re witnessing: a superpower using its economic might to shield itself and its allies from accountability for potential war crimes. The White House’s claim of “shameful moral equivalency” between Hamas and Israel reveals a fundamental misunderstanding – or deliberate misrepresentation – of international justice. The ICC’s role isn’t to play politics; it’s to investigate alleged atrocities regardless of who commits them.

The administration’s assertion that both the US and Israel are “thriving democracies with militaries that strictly adhere to the laws of war” would be more convincing if they were willing to subject those claims to independent scrutiny. Instead, we see sanctions against those who would dare investigate – hardly the action of nations with nothing to hide.

When Trump speaks of “harassment, abuse and possible arrest,” what he really means is accountability – something that powerful nations have long sought to avoid.

Consider the precedent this sets. A nation that helped establish the post-World War II international order now actively undermines it. The same United States that once championed the Nuremberg trials now sanctions those who seek to uphold similar principles. The message is clear: international law applies only to those without the power to reject it.

This assault on international justice doesn’t stand alone. It comes alongside Trump’s extraordinary claim that America will “take over” Gaza and transform it into the “Riviera of the Middle East” – after forcibly relocating its Palestinian population, of course. The casual colonialism of this proposal would be shocking if it weren’t so consistent with the administration’s broader contempt for international law.

trump, gaza
President Donald Trump has said that the US will “take over” and “own” Gaza as part of a plan to turn the enclave into “the Riviera of the Middle East”.

When press secretary Karoline Leavitt attempts to soften the Gaza proposal by claiming displacement would be “temporary,” or when Secretary Rubio speaks of an “interim” period, they’re engaging in the same doublespeak Orwell warned us about. History teaches us that “temporary” displacement often becomes permanent exile.

Even the symbolism is telling. Netanyahu’s gift to Trump of a golden pager – referencing a deadly operation that killed hundreds and injured thousands – transforms instruments of death into diplomatic trinkets. It’s a perfect metaphor for how this administration views international law: as an inconvenient obstacle to be gilded over and dismissed.

The defenders of this executive order might argue that the ICC overreaches, that it threatens American interests. But this misses the point entirely. International justice isn’t meant to be comfortable for the powerful. Its very purpose is to ensure that no one – not even the leaders of the world’s strongest nations – stands above the law.

The question facing the international community now is stark: Will we accept this brazen assault on international justice? Will we allow the powerful to declare themselves above the law while imposing it on others? The answer will determine not just the fate of the ICC, but the future of global accountability itself.

As we watch these events unfold, remember: The Party may tell us to reject the evidence of our eyes and ears, but truth has a way of persisting. The question is whether we’ll have the courage to defend it.
