The practice of refusing to rent homes to those in receipt of housing benefit has been ruled unlawful in the first βNo DSSβ discrimination case to be heard by a UK court.
The “momentous” court ruling found a single mother-of-two had experienced indirect discrimination when a letting agent refused to rent to her.
She ended up homeless with her two children, when her case was taken on by housing charity Shelter.
The judge ruled “No DSS” rental bans are against equality laws.
In a case that was heard at the York County Court at the start of this month, a 44-year-old disabled single mother of two challenged a letting agent for rejecting her application for a privately rented property on the basis of her being in receipt of housing benefit.
District Judge Victoria Elizabeth Mark found that the letting agent was in breach of the Equality Act for operating a policy of refusing to rent to individuals on benefits. The defendant ceased operating this policy in June 2019.
Such policies have become widely known as No DSS policies in reference to the now abolished Department of Social Security.
In the judgement, District Judge Mark said the defendantβs former policy was βunlawfully indirectly discriminatory on the grounds of sex and disability contrary to Sections 19 and 29 of the Equality Act 2010β.
Previously cases backed by Shelter have established that “No DSS” landlords and agents are guilty of indirect discrimination, but the cases were settled before any court heard them in full.
In February 2018, single mother Rosie Keogh won compensation for sex discrimination from a lettings agency that refused to consider her as a tenant because she was on state benefit, but the case was settled out of court.
The case was led by the strategic litigation team at Shelter, which has campaigned on the issue of No DSS discrimination for several years.
In 2018,Β research by Shelter and the National Housing FederationΒ found that at least one in 10 homes for rent advertised online said the home would not be rented to those on housing benefit.
The research found that No DSS policies especially disadvantage women and disabled people as they are more likely to receive housing benefit.
As a result of the ruling, the defendant has been ordered to pay the claimant Β£3,500, alongside their legal costs.
The case was supported by the Equality and Human Rights Commission, the Nationwide Foundation and barrister Tessa Buchanan at Garden Court Chambers.
Rose Arnall, the Shelter solicitor who led the case, said: β―βThis is the first time a court hasβ―fullyβ―consideredβ―aβ―case like this. It finally clarifiesβ―thatβ―discriminating against people in need of housingβ―benefitβ―is not just morally wrong, it isβ―against the law.β―
βShelter has been fightingβ―Noβ―DSSβ―for nearly two years, and thisβ―win in the courtsβ―isβ―whatβs neededβ―to endβ―these discriminatory practicesβ―for good.β―This sends a huge signal to letting agents and landlords that they must end these practices and do so immediately.β
Polly Neate, chief executive at Shelter, said: βThisβ―momentousβ―ruling should be the nail in theβ―coffin forβ―Noβ―DSS discrimination. It willβ―helpβ―give securityβ―and stabilityβ―toβ―people whoβ―unfairlyβ―struggle to find a place to live just because they receive housing benefit.

Luke Hall, minister for rough sleeping and housing, said: βEveryone should have the same opportunity when looking for a home and discriminating against someone simply because they receive benefits has no place in a modern housing market.
βThatβs why we have been working with landlords and letting agents to help ensure prospective tenants are treated on an individual basis and that benefits are not seen as a barrier to giving someone a place to live.β
‘No barrier’
Responding to the ruling, Chris Norris, policy director at the National Residential Landlords Association, said: “No landlord should discriminate against tenants because they are in receipt of benefits.
“Every tenant’s circumstance is different and so they should be treated on a case by case basses based on their ability to sustain the tenancy.”
But he added that the government could support tenants by ensuring benefits covered rents entirely.
Minister for rough sleeping and housing Luke Hall said the government had been working with landlords and letting agents to ensure tenants are treated on an individual basis and that benefits are not a barrier.
He added: “Everyone should have the same opportunity when looking for a home and discriminating against someone simply because they receive benefits has no place in a modern hosing market.”
